If you are designated by the reporting officer to be a victim of a Class C Assault, and you personally know the actor, you must contact the Municipal Court of the City of Odessa to prosecute your case. Charges cannot be filed on your behalf.  They may be reached at (432) 335-3301 to schedule an appointment with the prosecutor. 

TEXAS ATTORNEY GENERAL OFFICE CRIME VICTIMS’ ASSISTANCE AND COMPENSATION 

Crimes covered by Crime Victims’ Compensation are those in which the victim suffers substantial threat of physical or emotional harm or death.  These may include sexual assault, kidnapping, robbery, assault, or homicide.  To find out what benefits may apply in your circumstances, contact the Victims’ Assistance Coordinator for the Odessa Police Department at (432) 335-4927.  Assistance is available from the Coordinator in completing any required applications.

ADULT VICTIMS OF FAMILY VIOLENCE

  • "It is a crime for any person to cause you any physical injury or harm EVEN IF THAT PERSON IS A MEMBER OR FOR-MER MEMBER OF YOUR FAMILY OR HOUSEHOLD.

"NOTICE TO ADULT VICTIMS OF FAMILY VIOLENCE 

"Please tell the investigating peace officer: 

  • If you, your child, or any other household resident has been injured; or 
  • If you feel you are going to be in danger when the officer leaves or later. 

You have the right to: 

  • Ask the local prosecutor to file a criminal complaint against the person committing family violence; and 
  • Apply to a court for an order to protect you (you should consult a legal aid office, a prosecuting attorney, or a private attorney). If a family or household member assaults you and is arrested, you may request that a magistrate's order for emergency protection be issued.  Please inform the investigating officer if you want an order for emergency protection. You need not be present when the order is issued.  You cannot be charged a fee by a court in connection with the filing, serving, or entering a protective order. 

For example, the court can enter an order that: 

  • (1) the abuser not commit further acts of violence; 
  • (2) the abuser not threaten, harass, or contact you at home
  • (3) directs the abuser to leave your household; and
  • (4) establishes temporary custody of the children and directs the abuser not to interfere with the children or any property.

A VIOLATION OF CERTAIN PROVISIONS OF COURT-ORDERED PROTECTION (such as (1) and (2) above) MAY BE A FELONY.

CASE REQUIREMENTS

CREDIT/DEBIT CARD ABUSE 

  • Bank statement including specific transaction dates, times, and store locations; Not posting dates and times. Name of Bank. 
  • Complete canceled card number (not the account number).  
  • Completed and signed Dispute Form from the bank or credit card company

FORGERY

  • Legal copies of the front and back of all checks.  Affidavit of Forgery for all checks. 
  • Witness statements. 
  • Any additional information on possible suspects and locations where the checks were passed. 

For checks accepted electronically:

  • bank statement including specific transaction dates, times and store locations; Not posting dates and times. Name of Bank. 

    Complete canceled account number.

  • Completed and Signed an Affidavit of Forgery or Dispute Form from the bank listing each fraudulent transaction.  

THEFT AND CRIMINAL MISCHIEF (VANDALISM) 

  • A receipt or other documentation proving ownership and value of the property and/or two separate documented estimates proving the value of the replacement or repair of the property.  

IDENTITY THEFT 

  • Documents indicating that your specific identifying information was used. 
  • Documentation from the business holding the fraudulent accounts or from the IRS. 
  • Offense location and any available suspect information. 

HARASSMENT 

  • Documentation such as: printed or photographed text messages, letters, audio recordings, or other evidence showing harassment.
