Odessa Police Charge Woman in Connection to Aggravated Assault / Escape from Custody Investigation
Odessa Police arrested Magdalena Gutierrez, date of birth 07/15/1991, on 12-3-17 at approximately 1918 hours with Aggravated Assault “2nd Degree Felony” and Escape from Custody “Class A Misdemeanor”. Back on 10-22-17, Odessa Police were investigating a large disturbance at the Half Time Bar located at 2120 Andrews Highway.
A security guard asked an OPD officer to handcuff a female subject that had been involved in an altercation. The OPD officer detained the subject and left her with the security guard while they went inside the bar to investigate a fight involving multiple subjects. The officer later returned to find that the detained subject had escaped.
Investigation revealed that the suspect had previously struck a 40-year-old male subject on the left side of his head with a beer bottle. The victim sustained injuries on his head and was transported to Medical Center Hospital and later released. The victim advised that he wished to file charges against the suspect.
The suspect later made a post on her social media page, which showed a photo of the OPD handcuffs on her. The suspect was positively identified as Magdalena Gutierrez. Based on the facts and circumstances presented during the investigation, OPD detectives obtained warrants for Gutierrez, who was eventually charged and arrested accordingly.
OPD Detectives Charge Man in Connection to Stalking Investigation
Odessa Police charged Adalberto Rivera Olivas, date of birth 01/29/1977, on 12-1-17 with Stalking (Warrant) “3rd Degree Felony”. On 11-9-17, Odessa Police responded to the 1600 block of East 8th Street in reference to a criminal mischief call. Upon arrival, officers made contact with the 39-year-old complainant.
The complainant advised that her ex-husband, identified as Olivas, had been harassing her. The complainant advised that while she was sitting inside of her vehicle in the 1600 block of East 8th Street, Olivas drove by and threw a rock at her windshield. Olivas then “flipped her off” as he drove away.
OPD detectives reviewed surveillance footage, which showed a white truck driving by the complainant on several occasions. At one point, the vehicle stopped in front of the complainant’s vehicle before speeding off. OPD detectives also listened to a recorded phone conversation between Olivas and the complainant.
During the conversation, Olivas stated “there will be consequences, get ready”. Investigation revealed that the complainant had filed 8 reports against Olivas. The cases consisted of harassment, criminal mischief, stalking and assault. OPD detectives obtained a stalking warrant for Olivas, who was eventually charged accordingly.
