NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND
NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Odessa Housing Authority.
REQUEST FOR RELEASE OF FUNDS
On or about January 26, 2016 the City of Odessa will authorize the Odessa Housing Authority to submit a request to the U. S. Department of Housing and Urban Development, Public Housing Division for the release of Project Based Vouchers funds under 24 CFR Part 983 of the Project Based Voucher Regulations, to undertake a project known as 87th Street Housing Project Phase I for the purpose of providing Project Based Vouchers for up to 150 units of the 238 units being constructed under the Texas Department of Housing and Community Affairs Tax Credit Program. The agreement between the Odessa Housing Authority and 87th Street Apartment will be to provide the vouchers for a 15 year period. It is estimated the total of HUD funds for the 15 year period will be $17,550,000 with the total anticipated cost of the project set at $33,278,000. This project will be constructed on a portion of a 48.62 acre tract owned by the Odessa Housing Finance Corporation, 13.39 Acres, Section 38, Block 42, T-1-S, Texas and Pacific Railroad Company Survey, Odessa. Texas.
FINDING OF NO SIGNIFICANT IMPACT
The City of Odessa has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at City of Odessa Community Development Office, 119 West 4th Street, Suite 104, Odessa, TX. The record is available for review and may be examined or copied weekdays from 8:00 A.M to 5:00 P.M.
Any individual, group, or agency may submit written comments on the ERR to the City of Odessa Community Development. All comments received by January 25, 2016 will be considered by the City of Odessa prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
The City of Odessa certifies to the U. S. Department of Housing and Urban Development that Richard Morton in his capacity as City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The U. S. Department of Housing and Urban Development’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Odessa Housing Authority to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
The U. S. Department of Housing and Urban Development will accept objections to its release of funds and the City of Odessa’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Odessa; (b) the City of Odessa has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the U. S. Department of Housing and Urban Development; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the U. S. Department of Housing and Urban Development, Office of Public Housing, 6APH, at 801 Cherry Street, Unit #25, Suite 2500, Fort Worth, Texas 76102, Attention: Regina Hawkins, Director. Potential objectors should contact the U. S. Department of Housing and Urban Development to verify the actual last day of the objection period.
